RE: The tariff classification of a head turban, wrap skirt/cover-up, towels and slippers from China.

Dear Ms. Bhaumik:

In your letter dated September 26, 2001, received in this office December6, 2001, you requested a classification ruling.

The submitted samples are a head turban, wrap skirt/cover-up, towels and slippers composed of woven terry cloth 80% polyester/20% polyamide fabric. Style 0107-1 is a head turban used to dry hair after a shower. The hood like item twists a t the top and is secured by a button. Style 0107-2 is a wrap style item that can be worn at the waist or just above the bosom. The garment has elastic at the top and a hook with loop fastener. Style 0107-3 are towels of various sizes. The submitted sample is 15” x 35”. Style 0107-4 are slippers with an applied sole, open toe and a hook and loop fastener at the top. The applicable subheading for the head turban, Style 0107-1 will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted…felt or other textile fabric…whether or not lined or trimmed: Other: Of man-made fibers: Other: Not in part of braid, Other: Other: Other. The duty rate for 2001will be 19.7 cents\kg + 7.2% and for 2002, 19.4 cents\ kg + 7% ad valorem.

The applicable subheading for the wrap skirt/cover-up, Style 0107-2 will be 6208.92.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for “Women’s girls’ singlets and other undershirts, slips,…bathrobes, dressing gowns and similar articles, Other: Of man-made fibers, Bathrobes, dressing gowns and similar articles: Women’s.” The duty rate for 2001 will be 16.3% and for 2002, 16.2% ad valorem.

The applicable subheading for the towels, Style 0107-3 will be 6302.93.1000 Harmonized Tariff Schedule of the United States (HTS), which provides for “Bed linen, table linen, toilet linen and kitchen linen: Toilet linen and kitchen linen, of terry toweling or similar terry fabrics, Other: Of man-made fibers: Pile or tufted construction.” The duty rate for 2001 and 2002 will be 6.4% ad valorem. The applicable subheading for the slippers, Style 0107-4 will be 6404.19.3515, Harmonized Tariff schedule of the United States (HTS), which provides for “Footwear with outer soles of rubber or plastics: Footwear with open toes or heels…Other, House slippers.” The duty rate for 2001 will be 37.5% ad valorem and will remain the same for 2002. Your inquiry does not provide enough information for us to give a classification ruling on the bathrobe, Style 0107-5. Your request for a classification ruling should include a sample. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

The head turban, Style 0107-1 falls within textile category designation 659. The wrapskirt/cover up, Style 0107-2 falls within textile category 650 and the towels, Style 0107-3 falls within 666. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. There are not quota restraints or visa requirements for the slippers.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
